CODE OF CONDUCT

Through shared content, we encourage open and honest conversations and encourage everyone to share content, comment, and express their opinions in a courteous manner. By using this site, you agree to Simshare’s Code of Conduct.

Individuals using Simshare agree that they will not post illegal or offensive content.

Illegal Content

• Content that infringes the rights of any third party
• Copyright, patent and trademark infringements
• Breaches of data protection laws
• Defamatory or libelous words or personal attacks or insults
• Discriminatory or harassing content
• Comments that incite any form of harassment or other illegal activity
• Content that otherwise violates the law

Offensive Content

• Hateful, violent, obscene, profane, posts, links or images
• Posts that include inflammatory words and/or expletives
• Comments that are deemed to be solicitations, advertisements, or endorsements
• Multiple off-topic and/or incomprehensible posts by a single user
• Repetitive posts copied and pasted or duplicated by single or multiple users
• Posts that pose a breach of privacy for others by including personal information
• Posts that include incomprehensible content
• Content that is otherwise offensive

Simshare reserves the right to delete content that violates the Code of Conduct and to block users who do not adhere to the Code of Conduct. Repeat offences will result in a permanent ban from the site.

TAKEDOWN POLICY

Simshare is committed to giving users control over their content on the site.  Contributors may request removal of their content from the site at any time.  Their content will be removed promptly upon request.

Simshare is also committed to removing inappropriate content from our site as quickly as possible. We’ve established a thorough and careful removal process if the Simshare team receives a plausible complaint or are notified of any breach of the Simshare Code of Conduct. The resource or contribution will be removed immediately from the site and the complaint investigated. A decision on whether the resource or contribution can remain on the Simshare site will be made on conclusion of that investigation.

Complaint Process

If you have discovered any material on Simshare violates the Code of Conduct, please contact the Simshare team and provide the following information:

• your contact details;
• full details of the resource or contribution, including the author and title;
• the website address where you found the resource or material;
• the nature of your complaint;
• an assertion that your complaint is accurate and made in good faith; and
• if it is a breach of your own copyright that you are contacting us about, please state, under penalty of perjury, that you own the rights or are authorized to act on behalf of the rights owner.

Please send an email with the subject ‘Simshare Takedown Request’ to  Audrey Fried, afried@osgoode.yorku.ca  The following procedures will then be invoked:

1. 1. Simshare will acknowledge receipt of your complaint by email or letter and will make an initial assessment of the validity and plausibility of the complaint.
   2. The material will be temporarily removed from the Simshare environment until resolution.
   3. Simshare will contact the contributor who deposited the material. The contributor will be notified that the material is subject to a complaint, under what allegations, and will be encouraged to assuage the complaints concerned.
   4. The complainant and the contributor will be encouraged to resolve the issue swiftly and amicably and to the satisfaction of both parties, with one of the following outcomes:
      • The material will be returned to Simshare unchanged;
      • The material will be returned to Simshare with the appropriate changes; or
      • The material will be permanently removed from Simshare.

5. If the contributor and complainant are unable to agree a solution, the material will remain unavailable through Simshare until a resolution has been reached.
